Terms of service

TERMS OF SERVICE

These Terms apply to purchases from and use of Little Village Creators.

By placing an order or using our website, you agree to these Terms together with:

the relevant product listing
any applicable licence terms
any specific written agreement between you and Little Village Creators

Nothing in these Terms excludes, restricts or modifies rights or remedies that cannot legally be excluded, including rights under Australian Consumer Law.

Orders, pricing and availability

Prices, product availability and offers may change without notice.

Little Village Creators may correct genuine pricing, stock, technical, production or fulfilment errors.

Where an order cannot reasonably be fulfilled because of such an error, we may cancel the affected order and issue a refund.

If an ordered product becomes unavailable or is discontinued, we may offer:

a comparable alternative
a refund

If we contact you about an alternative and do not receive a response within 7 days, we may refund the affected item or order to the original payment method.

Requests to cancel or change an order after purchase are considered case by case and are not guaranteed once processing or production has begun.

Customers under 18

If an order is placed in the name of a person under 18, Little Village Creators will assume the purchase was made with the knowledge and consent of a parent or guardian.

Age alone will not be treated as a reason for a change-of-mind refund.

Any non-excludable legal rights remain unaffected.

Custom and personalised orders

Where a proof or mockup is provided, production begins after approval.

The applicable processing period begins from the date the proof or mockup is approved.

Once a proof has been approved and production has started, a custom or personalised order cannot be cancelled for change of mind.

We will make reasonable efforts to flag anything that appears incorrect.

However, the customer is responsible for checking and approving:

spelling
wording
colours
layout
design choices
other details shown in the proof

Proof revisions are handled case by case.

Customers are responsible for ensuring they have permission to use any:

artwork
logos
text
trademarks
images
other material

they supply for custom work.

Little Village Creators may refuse custom requests that are:

unlawful
offensive
infringe another person’s rights
requests to directly copy another creator’s work

Unless the customer asks us not to, Little Village Creators may photograph completed custom orders and use those photographs on our:

website
social media
marketing materials
portfolio

Intellectual property

Little Village Creators retains ownership of its:

branding
product photography
graphics
written content
product descriptions
original designs
digital files
other original material

Unless an individual product listing or licence expressly states otherwise, purchases are for the purchaser’s authorised end use only.

Products, designs and digital files purchased from Little Village Creators must not be:

copied
reproduced
manufactured for resale
redistributed
shared
republished
commercially exploited

unless expressly authorised.

Customers may sell finished creations made using Little Village Creators physical tools, including cakes, decorated cookies, clay pieces and similar end products.

Customers may not copy, reproduce or manufacture the physical tool or design itself for resale unless expressly authorised.

You must not remove or obscure:

watermarks
branding
copyright notices
licence terms
ownership information

Scraping, bulk downloading, data mining, automated extraction or systematic copying of our website content or digital products is prohibited.

Digital products and licences

Digital products are considered supplied once the download link or access has been made available to the customer, whether or not the customer downloads the file immediately.

Unless the individual listing says otherwise, digital files are licensed for personal use only.

The licence applies to one purchasing person or one business entity at a time.

Multiple physical prints may be made for reasonable personal use.

Commercial-scale production or sale of the printed tool itself is not permitted without a separate commercial licence.

Finished products made using printed tools

Customers may use printed tools made from our digital files to produce finished goods for sale.

Examples include:

cakes
decorated cookies
clay pieces
other finished creator products

A baker, cookier, clayer or other creator therefore does not need a commercial file licence simply because the finished product made using the tool is sold.

Classes and workshops

Multiple printed copies may be used during a paid class where:

the purchaser uses the tools to teach the class
the tools remain with the purchaser afterwards

If printed tools are:

sold to attendees
given to attendees
included in a paid kit
included in a workshop pack for attendees to keep

a commercial licence is required unless the product listing expressly allows that use.

Social media

Customers are welcome and encouraged to tag Little Village Creators when sharing finished creations made using our products.

Attribution is appreciated but is not mandatory unless a specific collaboration, licence or listing states otherwise.

Digital-file restrictions

Unless the product listing or licence expressly permits it, you must not:

resell a digital file
share a digital file
redistribute a digital file
upload a digital file elsewhere
transfer a file or download link
share a file with employees
share a file with contractors
share a file with manufacturers
share a file with print farms
share a file with third-party printing services
share a file with clients
give another person access to the file
modify a file for redistribution
create derivative digital files for resale
create moulds, casts, templates, stamps, cutters or similar derivative products for resale
upload files or designs to AI systems
upload files to 3D-generation platforms
upload files or designs to datasets
use files for AI training, generation, remixing or derivative creation
reverse engineer a file
decompile a file
extract source geometry
reconstruct the underlying design
make or distribute copies beyond those technically necessary for authorised downloading and use

Digital licences and transfer

A digital licence is non-transferable by default.

If a purchasing business is sold as a going concern, the licence may transfer with the business provided that:

the former owner permanently deletes all retained copies
the former owner no longer uses the file
the former owner no longer retains access to the file

Updates

Standard digital-file purchases do not automatically include future:

revisions
updates
new versions
replacement versions

unless the product listing says otherwise.

New or substantially revised versions may be sold as separate products.

Courses or other products may specifically include ongoing updates where stated in the relevant listing.

File storage

Customers are responsible for downloading and securely storing purchased digital files.

Indefinite re-download access is not guaranteed unless specifically stated.

Commercial licences

Where a commercial licence is offered, it may permit the sale of physical prints made from a digital file.

The digital file itself remains protected and must not be shared, resold, redistributed or uploaded elsewhere unless the licence specifically permits it.

Commercial licences may be revoked for:

serious misuse
infringement
repeated breaches of the licence

If a commercial licence is revoked, the customer must:

stop producing new items immediately
delete all digital copies held

Unless the circumstances or applicable law require otherwise, physical stock legitimately produced before revocation may be sold through.

Digital compatibility and 3D printing

Digital files are supplied in the file format or formats stated on the product page.

Conversion to another file format is not included unless specifically stated.

Customers are responsible for checking compatibility with their own:

printer
slicer
software
hardware

Little Village Creators 3D-printing files are designed and tested using Bambu Lab 3D printers.

Compatibility and results on other printers, slicers or setups may vary.

Any recommended print settings are a starting point only.

Settings may need to be adjusted for the customer’s:

printer
filament
slicer
calibration
environment

Print quality may vary for these reasons.

A poor print result by itself does not necessarily mean the digital file is faulty.

To the extent permitted by law, Little Village Creators is not responsible for:

failed prints
wasted filament
machine damage
other losses

caused by:

incorrect printer setup
incorrect slicer settings
hardware faults
incompatible equipment
unsuitable materials
misuse of the file

Food-contact use

Only use a product for food contact where the individual product listing indicates that the product or file is intended for that purpose.

For digital files intended to produce food-contact tools, use PLA or PETG only.

The customer is also responsible for ensuring that the specific:

filament
additives
colourants
nozzle
printer setup
finishing method

are suitable for food-contact use.

A material being described as PLA or PETG does not by itself guarantee that every filament or printing setup is suitable for food contact.

Inspect 3D-printed food-contact tools before every use.

Replace them if they become:

cracked
deeply scratched
warped
otherwise damaged

Care of 3D-printed products

Unless an individual product listing says otherwise:

hand wash only
use water no hotter than 50°C
do not soak
do not put in a dishwasher
keep away from prolonged heat
do not leave in hot vehicles
keep away from prolonged direct sunlight
use only for the intended purpose
follow any product-specific care instructions

Safety

Products and printed items are not toys unless specifically stated.

Keep small parts and products with sharp edges away from babies and young children.

Small parts may present a choking hazard.

To the extent permitted by law, Little Village Creators is not responsible for damage caused by:

misuse
unauthorised modification
improper storage
unsuitable materials
failure to follow care or safety instructions

3D-printing characteristics

Visible:

layer lines
seams
support marks
minor surface variations

are normal characteristics of the 3D-printing process and are not faults on their own.

Small dimensional variations may occur because of:

printing tolerances
measuring methods

Colours may also vary because of:

screen settings
photography
lighting
filament or material batches
normal manufacturing variation

Exact colour matching is not guaranteed unless specifically stated.

Promotions and discount codes

Promotional codes, discounts and sale offers are subject to their stated terms.

They cannot be combined with other offers unless expressly allowed.

Discount codes must generally be entered at checkout.

They cannot normally be applied retrospectively after an order has been placed.

The price and promotion in effect when the order is placed is the one that applies, even if a different promotion begins later.

Little Village Creators may change or end a promotion early where there is a genuine:

error
stock issue
misuse
other reasonable business reason

Promotional discounts do not apply to gift cards unless specifically stated.

Gift cards and store credit

Unless a different lawful period is stated, gift cards and store credit expire 3 years from the date of issue.

They are:

non-refundable
not redeemable for cash

except where required by law.

Email, accounts and digital access

Customers are responsible for:

providing a correct email address
keeping access to their email secure
keeping account or login details secure

Little Village Creators is not responsible for unauthorised access caused by a customer sharing login details or failing to secure their account.

If an expected:

order email
download email
account email
course email

does not arrive, customers should check their junk or spam folder before contacting us.

Customers should notify Little Village Creators promptly if their email address changes, particularly where course updates, support or ongoing access may depend on it.

Conduct and refusal of service

Little Village Creators may refuse service, cancel and refund an order, or refuse future orders where there is:

fraud
serious misuse
harassment
threatening behaviour
abusive behaviour
deliberate exploitation of a pricing or promotional error
an improper chargeback
another serious breach of these Terms

A single serious incident may be sufficient for future orders to be refused or cancelled.

Payment disputes and chargebacks

Customers are expected to contact Little Village Creators and allow us a reasonable opportunity to resolve an issue before initiating a payment dispute or chargeback.

We will work with customers to provide any remedy they are entitled to under our policies and Australian Consumer Law.

Where a payment dispute or chargeback is raised, Little Village Creators may provide relevant evidence to the:

bank
card issuer
payment processor
dispute-resolution provider

This evidence may include:

order information
tracking information
correspondence
digital download records
proof approvals
transaction records
other relevant evidence

Force majeure

Little Village Creators is not responsible for delays or failure to perform caused by events outside our reasonable control, including:

postal disruptions
natural disasters
supplier failures
internet or system outages
government restrictions
similar external events

If a delay becomes substantial, we may offer the customer the choice of:

continuing to wait
cancelling the unfulfilled portion of the order for a refund

Liability and Australian Consumer Law

To the maximum extent permitted by law, Little Village Creators excludes liability for losses caused by:

misuse
unauthorised modification
unsuitable equipment
unsuitable materials
failure to follow instructions
events outside our reasonable control

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded under the Competition and Consumer Act 2010 (Cth), Australian Consumer Law or other applicable law.

Changes to policies and terms

Little Village Creators may update its:

policies
licences
care instructions
Terms

from time to time.

Purchases are generally governed by the version that applied when the order was placed, together with any product-specific terms that applied to that purchase.

Governing law

These Terms are governed by the laws of Victoria, Australia.

Subject to any rights a customer has to use another forum under applicable law, disputes may be brought before courts and tribunals with jurisdiction in Victoria.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in effect to the fullest extent permitted by law.

No waiver

If Little Village Creators chooses not to enforce a term on one occasion, that does not mean the term has been permanently waived.

Entire agreement

These Terms, the relevant product listing, applicable licence terms and any specific written agreement with the customer together form the agreement relating to the purchase.
